These terms and conditions set the contractual requirements. They are in place to mitigate disputes and define the expectations of mutual respect for the values and reputation of all parties. All clients and participants accept the following terms and conditions:
- The description and timelines for all products and services and timelines are as outlined in individual quotes.
- Fees and payment terms: The total cost of the services is outlined in individual quote format and payment is required upfront.
- Privacy and confidentiality: All clients and participants accept accountability for individual responsibilities for information privacy, confidentiality and security.
- Bayside Board Co will ensure adherence to the legislation and ensure information is stored confidentially. Bayside Board Co accepts responsibility to ensure it has effective information security controls in place.
- Intellectual Property (IP) - reports, findings, or materials produced can be distributed by clients internally. Clients will respect copyright and trademark rules, such as attribution, adaptation, IP, commercial or non-commercial use.
- Both parties are responsible for participating in products and services in a professional manner.
- Conditions for termination (by either party) may only occur as a result of a breach of contract or failure to provide resources. Requests for withdraw and cancelation of services will not be considered.
- Liability and indemnification: There are limitations of liability for Bayside Board Co as an evaluator and assessor that are based on the gathering of perceptions of individuals and indemnification provisions are in place to protect against claim.
- Dispute resolution: The process for resolving disputes is initially by submitting a complaint through the bbc@baysideboardco.com and further resolution through mediation or arbitration.
- Compliments and testimonials: The process for sharing compliments with Bayside Board Co are is by email to bbc@baysideboardco.com. Bayside Board Co will provide a summary of engaged clients and compliments recieved on the website.
- Amendments: The procedure for making changes to these terms and conditions is by written consent for any amendments through to bbc@baysideboardco.com.
- Independent status: Bayside Board Co provides products and services as an independent provider and not an employee.
Additional considerations: There is no capacity for Bayside Board Co to customise and tailor these terms and the products for individual clients and participants.
